Traffic Violation Crime

There are different traffic laws enforced by the government, which must be obeyed by every citizen, and people often violate them on streets and national highways. Every American is eligible for obtaining a driving license after attaining the age of sixteen years, and ninety percent of Americans over sixteen years of age are driving their vehicle with more than one vehicle registered on their name.

The various vehicles cover trillions of miles every year, and there are millions of traffic violations under the laws of states like crossing red lights, driving speedily, rash driving, driving under the influence of liquor or drugs, and many more says Attorney Miya Griggs. Traffic officials issue challan to the people who violate traffic laws and are decided in the state courts.

There are some traffic violations that cause damage due to direct fault or negligence, generally known as “strict liability” offenses. Such crimes are committed without any criminal intention. If a person does anything which is prohibited under the state laws, he is liable to be charged. The different offenses under Strict- liability offenses are as follows:

  • Driving Speedily
  • Duty of the drivers to obey the traffic rules to avoid harm to others.
  • Driving a car into the wrong lane.
  • Wrong Parking, particularly in a handicap area without the requisite sticker.
  • Expired parking meters.
Overspending is a traffic offense. Hundred pounds and three penalty points are marked in your driving license if you are found driving the vehicle at more than the prescribed speed by the traffic official. You are banned from driving if twelve points are added to your license in three years.

Drink and drive is also a traffic offense. The speed limit while driving when one is drunk differs in England and Wales and Scotland. Your blood samples are taken and the amount of alcohol present in it which varies from person to person, there are breath meters which determine whether you are drunk or not and in some cases your urine sample is taken to know the number of alcohol contents for the punishment which could be a fine, banned from driving and even be put behind bars says Miya Griggs.

You cannot drive if you are a drug addict, and you may be charged with violation of traffic laws if any traces of illegal drugs are found in your blood. You can also be punished even if you have a prescription of the medication which affects your driving ability. The punishment includes a hefty fine, banned from driving for at least one year and may be imprisoned up to six months. The government of Scotland is bringing more strict laws from 21st October 2019 in terms of speed limits and roadside testing says Attorney Miya Griggs. It is mandatory for the driver as well as other people, including children, to wear seatbelts that are seated in the car. Fine up to 500 pounds can be charged in failing to do so.

Nature of Crime

Crime has many forms, and it has a varied nature. The nature of crime depends on the intensity of the crime. Crime is basically an unlawful activity. The person involved in illegal activities is punishable under the laws enacted by the Congress duly approved by the president says Miya Griggs. There are four conditions laid down by the government for an act to be considered a crime. Those activities which are wrong for the society that is harmful to the public in general or other dangerous actions. One can plead the case in the court of law.

The person is said to be convicted of criminal offenses in Canada if it is proved that the mental condition of the culprit is stable and the result of the voluntary movement of the body at the time of the offense by the Crown says Attorney Miya Griggs. Acting physically while committing a crime is termed as Actusreus by criminal law. When the crime is committed intentionally, and the culprit is fully aware that the act is against the law. The intent to commit an illegal act means to do something deliberately, which is unlawful, doing something rash, should know its consequences beforehand. The purpose is not similar to the motive of the crime.

The intent is the state of mind of a culprit in which he commits a crime and willingly goes against the law, whereas motive is the reason behind the crime. Most of the time, men’s rea can be established by proving that a person convicted has beforehand knowledge of some facts. In other cases, the men’s rea can be determined by verifying that a charged person is unaware of the crime, rashness, or committing a crime blindly. One must ensure that whatever you do does not cause harm.

The Crown is not required to prove men’s rea in less severe cases to prove the guilt of the crime. These types of crimes are mostly against the laws framed by the authorities. The matters connected with the protection of the environment and the safety at the workplace are dealt with by the federal and state governments says Miya Griggs.

Those crimes which do not need men’s rea are classified into strict liability offenses and absolute liability offenses. In severe liability offenses, the accused can defend himself in the court that he took care of every possible legality while the crime was committed. The convicted person took all precautions so that he could prove himself innocent in the court of law. In contrast, if you are not carrying a driving license when driving, which is an absolute liability offense, you cannot defend yourself.

What Drug Crime?

The different laws framed by the central and state governments for drug crimes are stringent. The laws of countries for drugs are lesser rigid as compare to federal drug laws. The imprisonment period is long as far as federal drug charges are concerned, and according to the drug laws in the states, the person involved in a drug crime is generally sentenced for a short period or may be sent to the probation officer for a fixed period instead of putting him in the jail says Attorney Miya Griggs. The person who has a record of keeping the drugs has to face hard consequences. This is just a general description of the various crimes involving drugs.

Whatever required to prepare, inject, inhale or hide illegal drugs is termed “drug paraphernalia”. The equipment used in making such drugs is also referred to as drug paraphernalia. It is unlawful to deal, import and export of any such types of equipment used for drugs as per the National Drug Intelligence Center. It is a criminal offence when some person is found in selling and buying drugs.

Following are some of the examples of drug crimes.

There are different varieties of pipes, rolling papers and syringes which are basically used in inhaling drugs. Most of the equipments used are shaped in such a manner that no one doubts them and are legal. Water Pipes commonly called Bongs come with a label that it should be used with tobacco only which is also against the law and one may be charged with drug paraphernalia after examining the source of the purchase and its shape.

The various drug laws are different in the states that depends on the nature of the drug in your possession and its price in the international market. Nevertheless, it is a crime under both federal and state governments to keep anything which is prohibited and against the law such as marijuana, cocaine or heroin says Attorney Miya Griggs.

A person is framed under the rule of law if found having a small or large quantity of any of the illegal substances in his possession. The person is convicted of Simple possession if a small amount of drugs is found from him and if he possesses a large number of drugs for selling them to others is framed under the charge of possession and the offence of this nature invite severe penalties.
