Crime has
many forms, and it has a varied nature. The nature of crime depends on
the intensity of the crime. Crime is basically an unlawful activity. The
person involved in illegal activities is punishable under the laws
enacted by the Congress duly approved by the president says Miya Griggs.
There are four conditions laid down by the government for an act to be
considered a crime. Those activities which are wrong for the society
that is harmful to the public in general or other dangerous actions. One
can plead the case in the court of law.

The person
is said to be convicted of criminal offenses in Canada if it is proved
that the mental condition of the culprit is stable and the result of the
voluntary movement of the body at the time of the offense by the Crown
says Attorney Miya Griggs.
Acting physically while committing a crime is termed as Actusreus by
criminal law. When the crime is committed intentionally, and the culprit
is fully aware that the act is against the law. The intent to commit an
illegal act means to do something deliberately, which is unlawful,
doing something rash, should know its consequences beforehand. The
purpose is not similar to the motive of the crime.
The intent
is the state of mind of a culprit in which he commits a crime and
willingly goes against the law, whereas motive is the reason behind the
crime. Most of the time, men’s rea can be established by proving that a
person convicted has beforehand knowledge of some facts. In other cases,
the men’s rea can be determined by verifying that a charged person is
unaware of the crime, rashness, or committing a crime blindly. One must
ensure that whatever you do does not cause harm.
The
Crown is not required to prove men’s rea in less severe cases to prove
the guilt of the crime. These types of crimes are mostly against the
laws framed by the authorities. The matters connected with the
protection of the environment and the safety at the workplace are dealt
with by the federal and state governments says Miya Griggs.
Those
crimes which do not need men’s rea are classified into strict liability
offenses and absolute liability offenses. In severe liability offenses,
the accused can defend himself in the court that he took care of every
possible legality while the crime was committed. The convicted person
took all precautions so that he could prove himself innocent in the
court of law. In contrast, if you are not carrying a driving license
when driving, which is an absolute liability offense, you cannot defend
yourself.
